Flashcard Buddy Terms and Conditions

1. Agreement to Terms

By using Flashcard Buddy, you agree to these Terms. If you disagree with any part of the terms, you may not use our service.

2. Description of Service

Flashcard Buddy is a tool that allows users to create, manage, and study flashcards. Users share content with us, we use a third-party AI to generate flashcards and study materials, and then provide the results to the user. Our service also includes an AI tutor and chat features designed to assist with studying and learning.

3. User Accounts

You must create an account to use Flashcard Buddy. You are responsible for maintaining the confidentiality of your account.

4. Free Trial and Payments

We offer free accounts with limited free credits for the service. After the credits are used, Flashcard Buddy is a paid service. We offer discounts for bulk purchases.

5. Refund Policy

We offer a 100% money-back guarantee for all purchases when requested within 45 days of purchase. After 45 days, refunds are subject to Flashcard Buddy's discretion. Refunds will not be issued to users whose accounts have been terminated for violations of these Terms, including but not limited to abuse of AI features.

6. Acceptable Use

You agree not to use Flashcard Buddy for any unlawful purpose or in any way that violates these Terms.

You agree to not use Flashcard Buddy to generate flashcards or study materials for any illegal or prohibited purposes.

You agree to not use Flashcard Buddy to generate flashcards or study materials that contain explicit or illegal content.

You agree to not sign up for multiple personal accounts.

7. User Content and License

You retain any ownership rights you have in notes, documents, images, flashcards, answers, prompts, and other material you upload, submit, create, or make available through Flashcard Buddy ("User Content").

To operate, improve, and promote Flashcard Buddy, you grant LaBounty Labs, LLC a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, analyze, modify, adapt, translate, excerpt, combine, create derivative works from, display, publish, distribute, and otherwise use your User Content and study materials generated from it.

This license allows us to use User Content and generated flashcards to:

• Provide and improve Flashcard Buddy's study, generation, grading, and tutoring features.
• Identify common subjects, courses, concepts, vocabulary, and learning needs.
• Create, edit, combine, and publish original or derivative flashcard decks, study guides, practice materials, topic pages, and other educational resources.
• Use excerpts, examples, and derivative materials to market and promote Flashcard Buddy.

When we repurpose private User Content for public educational or marketing materials, we may rewrite, reorganize, aggregate, or combine it with other sources. We will not intentionally publish your original private uploaded file, your account identity, or personal information contained in your account as part of that material unless you have separately made it public.

You represent that you have the rights and permissions necessary to upload User Content and grant this license, and that our permitted use of it will not violate another person's intellectual property, privacy, confidentiality, publicity, contractual, or other rights. Do not upload confidential records, personally identifying student information, unreleased examinations, or material you are not permitted to share.

We are not required to compensate or attribute you for uses permitted by this license. We may remove, decline to use, or stop distributing any User Content or derivative material at our discretion.

8. AI Tutor and Chat Features

Flashcard Buddy provides AI-powered tutor and chat features that are designed strictly for studying and learning purposes. By using these features, you agree to the following:

• You will only use the AI tutor and chat features for legitimate educational and study-related activities.
• You will not use these features for any illegal, harmful, or inappropriate purposes.
• You will not use these features to generate content related to self-harm, violence, harassment, or any other harmful activities.
• You will not use these features for any purpose unrelated to studying or learning.

Abuse of AI features, including but not limited to using them for illegal activities, inappropriate content, self-harm related content, or non-studying purposes, will result in immediate termination of your account without refund.

9. Prohibited AI System Interactions

You agree not to attempt to hack, bypass, circumvent, or otherwise interfere with the protections, safety measures, or content filters of our AI systems and features. This includes but is not limited to:

• Attempting to manipulate the AI through prompt injection or jailbreaking techniques.
• Trying to bypass content filters or safety restrictions.
• Reverse engineering or attempting to extract the underlying AI models or prompts.
• Using automated tools to probe or exploit the AI systems.

Any attempt to hack, bypass, or manipulate our AI systems will result in immediate termination of your account without refund, and we reserve the right to pursue legal action where applicable.

10. Intellectual Property

The Flashcard Buddy service and its original content, features, and functionality are owned by LaBounty Labs, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Except for the license you grant above, these Terms do not transfer ownership of your User Content to LaBounty Labs, LLC. Flashcard Buddy may own or license the software, templates, organization, editorial additions, and other original elements we contribute to public decks and derivative educational resources.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation.

12. Limitation of Liability

In no event shall LaBounty Labs, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Wyoming, United States, without regard to its conflict of law provisions.

14. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
